Importance of Deed of Sale Motorcycle

The Deed of Sale of a Motorcycle is a mandatory document to transfer ownership. When you sell your motorcycle to a person, you must prepare a deed of sale motorcycle and also apply for the transfer of ownership to LTO (Land Transportation Office).

The LTO will accept your application for transfer of ownership of a motorcycle only if you submit a valid deed of sale of the motorcycle together with the prescribed application form and required documents.

It means that you cannot request for transfer of ownership of your motorcycle to LTO without having the motorcycle deed of sale signed by you, the seller (vendor) and the buyer (vendee) and notarized by a Notary Public.

Motorcycle Deed of Sale Requirements

In order to prepare the Deed of Sale Motorcycle, you must have all required information and documents ready. Here I provide its requirements as under:

  • A Valid Government Issued ID of the Seller/Vendor
  • A Valid Government Issued ID of the Buyer/Vendee
  • Complete Info about the Motorcycle (Make, Model, Engine No., Chassis No., Plate No., Colour and Year)
  • Exact Price of the Motorcycle for the Transaction, Mutually Agreed by the Vendor and the Vendee
  • Name and Signature of the Vendor and the Vendee
  • Name and Signature of Two Witnesses
  • The Deed of Sale of a Motorcycle must be prepared in presence of the Vendor, the Vendee, a Notary Public (Lawyer) and Two Witnesses.

Deed of Sale Motorcycle Fees

You do not need to pay any fee for the deed of sale, but you must pay the notarization fee to the Notary Public. The Deed of Sale Motorcycle Notarization Fee is 1-2 percent of the selling price of the motorcycle.

For example: If you sell your motorcycle for ₱10000, you are required to pay ₱100 to ₱200 as a Notarization Fee to the Notary Public for notarizing the deed of sale of the motorcycle.

How to Prepare Deed of Sale of a Motorcycle

In order to prepare a deed of sale of a motorcycle, you must check its requirements. I have shared the deed of sale motorcycle requirements above, you should collect all required information and documents that you will need for it.

Thereafter you should copy the same of deed of sale motorcycle to a text editing app (e.g. Word) and fill it up with correct information about the vendor, the vendee and the motorcycle.

Once you finish filling up basic information in the deed of sale motorcycle, take print and go to a Notary Public Office. Call up the vendee (buyer of the motorcycle) at the Notary Public.

Both you (vendor) and the buyer/vendee should provide a valid government ID and sign the deed of sale in presence of the Notary Public. Then the Notary Public should fill up remaining information and notarize the deed of sale motorcycle as per law rules.

In this way, you can prepare a deed of sale of a motorcycle with help of knowledge shared in this post and a Notary Public (lawyer).

What to Do Next After Completing Motorcycle Deed of Sale

After completing the deed of sale of a motorcycle, the next step is to obtain a clearance from PNP-HPG (Philippine National Police Highway Patrol Group), it is a legal evidence to prove that the motorcycle is not stolen.

Thereafter you need to submit a request for transfer of ownership at an LTO Office. You can prefer the LTO Office that is close to your location. To LTO will accept your request for transfer of ownership of a motorcycle only if you submit all required documents given as under.

  • Notarized Deed of Sale of the Motorcycle
  • Original Certificate of Registration (CR)
  • Latest Original Official Receipt (OR)
  • PNP-HPG Clearance
  • CTPL Insurance Copy or e-copy
  • Photocopy of A Valid Government ID of the Vendor/Seller
  • Photocopy of A Valid Government ID of the Vendee/Buyer
  • Motorcycle Emission Test Result
  • Motor Vehicle Inspection Report (MVIR)

After you submit the request for transfer of ownership of the motorcycle with above mentioned documents, the LTO will process your request to register the motorcycle on the buyer’s name.

LTO Transfer of Ownership Deadline and Penalties

The Land Transportation Office has set a deadline of 5 days for the vendor/seller and 20 days for the vendee/buyer. Within the given time period, both the vendor and vendee must submit a request for completing transfer of ownership of the motorcycle.

The countdown of deadline period starts from the date of deed of sale was notarized by the Notary Public or the date on which the vendor handed over the motorcycle to the vendee, whichever happened first.

In case the seller/vendor and/or the buyer/vendee fail to report the sale/purchase of the motorcycle in given deadline, the LTO will charge ₱5000+ Penalties for Late Reporting of the Sale.

Final Words:

The deed of sale motorcycle is very important. Without the deed of sale, the LTO does not approve the request for transfer of ownership. Above I have shared a sample of deed of sale of a motorcycle, its requirements, fees and preparation process.

Kindly note that the LTO has set rules for transfer of ownership that both the vendor/seller and the vendee/buyer must follow throughout the entire process. For more queries, you can ask in the comment section.
